1): General

These are the terms of use for BA.Life (operated by The Firm Organisation, "us", "we", or "our") platform and mobile application, the services, features, apps, services and technologies that are offered.

Please read these Terms and Conditions carefully before using our BA.Life mobile application (the "Service").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

2): The Services We Provide.

The mission of BA.Life is to provide a number of key services as per the below that allow our users to showcase what, how & why they love what they do.

Help users learn about interesting events.

We provide up-dates about up-coming events, where registered users can see who is attending and can register their interest in attending as well as share the details on other social media platforms. We use the data that has been provided to make suggestions as to other events that may interest users and to find other event opportunities that may be of interest.

Empower users to share ideas and thoughts.

There are many ways that users can express themselves on BA.Life, this includes the ability to share content (text, graphics, videos, or other material) and comment on other users content. When someone comments on content, we may use this data to promote and encourage similar content that the users like. By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service.

You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms.

Provide a personalized experience for users.

Users are able to up-date their profiles with information about themselves via a Bio and can post up-dates on their activities. At present we do not use this personal data for anything.

Connect people.

We help users find like-minded other users, where users can be searched and followed as well as having the ability to share a link to BA.Life. We use this data to track who the biggest users are and to research into how they use BA.Life to improve the experience of other users.

3): Community Guidelines.

BA.Life provides its users with a number of services as outlined above so all of our users can share information with the community. Our community guidelines exist to ensure this platform lets each member take from it what they need whilst cultivating an open, welcoming base for all who use it. We hope the conduct outlined below reads easy and we expect this to be honoured by all of our members. Everything outlined below works in conjunction with the terms of service and will form your agreement with BA.Life.

Mutual respect.

In our community we respect each other connecting people from all over the world, from a wide spectrum of cultures and backgrounds. This diversity brings many perspectives and all users must respect this when they share, post or comment. Profanities and abusive language is absolutely not permitted.

Inclusion.

Our community is open to all and is a place to share and be inclusive of all people. Discrimination, hostility or intentional exclusion of persons will not be tolerated under any circumstance.

Ask for help when unsure.

Moderate Yourself.

Anything you share from the site to your other social platforms should be done so in an appropriate manner. It is recommended you never post your address or phone number.

General.

If you don't feel that you can abide by our Community Guidelines as outlined above, maybe BA.Life isn't for you. We want everyone to have a great time and get the most from the world wide web of ambassadors. If we discover you are not operating by these guidelines, we will take action, which may mean deleting your account with or without warning.

4): Our Data Policy and Your Privacy Choices.

We collect and use your personal data in order to provide the services described above to you. You can learn about how we collect and use your data in our Privacy Statement.

5): Up-Dates and Changes

The BA.Life team is constantly evaluating, improving and investing in the Services. This means that we will need to up-date our Terms of Service from time to time. In line with our legal obligations we will notify you in advance of any changes before they come into effect and will allow you time to review. Once these changes come into effect, you will be bound by them if you continue to use BA.Life. If the revised terms and conditions are not to your agreement, you can delete your profile via account settings at any time.

6): Account Suspension or Termination.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

We want BA.Life to be a place where people are safe to express their thoughts and ideas. We make every effort to review the content that has been posted and if found that you as a user have clearly, seriously, or repeatedly violated our terms or policies, including in particular our Community Guidelines, we may suspend or permanently disable access to your account. If this happens, we will notify you about your account the next time you try to access it. If at any time your account has been disabled please contact us and we can review with you.

7): Warrant.

You represent and warrant that:

  • The Content you publish is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and
  • The posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

8): Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of BA.Life and its licensors. The Service is protected by copyright, trademark, and other laws of both Ireland and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BA.Life.

If you post or share content containing music, you must comply with all relevant copyright and Intellectual Property legislation. BA.Life takes no responsibility for your unauthorised posting or sharing of content.

9): Indemnification.

You undertake that you will indemnify BA.Life and keep BA.Life fully indemnified against all actions, claims, proceedings, costs and damages (including any damages or compensation paid by BA.Life on the advice of its legal advisers to compromise or settle any claim) and all legal costs or other expenses arising out of any breach of any warranties or out of any claim by a third party based on any facts which if substantiated would constitute such a breach.

10): Liability.

Notwithstanding any other provision of this Agreement, BA.Life shall NOT be liable to any other Party to this Agreement in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by you or your Affiliates of an indirect or consequential nature including without limitation any economic loss or other loss of turnover, profits, business or goodwill.

11): Links to Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by BA.Life.

BA.Life has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that BA.Life shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

12): Disputes.

We try to provide clear rules so that we can limit or hopefully avoid disputes. If a dispute does arise, however, it's useful to know up front where it can be resolved and what laws will apply. All cases, you agree must be resolved in a competent court in the Republic of Ireland and that Irish law will govern these Terms and any claim, without regard to conflict of law provisions.

13): Entire agreement

This agreement constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

14): Severability

If any provision of this agreement is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from this agreement and rendered ineffective as far as possible without modifying the remaining provisions of the agreement, and shall not in any way affect any other circumstances of or the validity or enforcement of this agreement.

15): Non-Transferable

You will not transfer any of your rights or obligations under these Terms to anyone else without our consent. You should know that we may need to change the username for your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name you use in everyday life). We always appreciate your feedback and other suggestions about our products and services. But you should know that we may use them without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.

16): Governing Law

These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

  • You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
